1. General Information and Transparency

RAIA CHATGPT is an artificial intelligence software that can automatically generate output. The application focuses on using texts from databases with a search for words to provide the user with the most relevant and accurate information possible. When using RAIA CHATGPT please be aware that you are interacting with an AI.

2. Potential Errors

Please note that RAIA CHATGPT is not human and therefore has no human intelligence. The answers and results generated by RAIA CHATGPT are based, among other things, on predefined algorithms, databases and probability calculations.  Therefore, please keep in mind that errors or wrong results may occur, and we advise you to question the information, especially if it appears implausible. While we take a variety of measures to create a secure environment, please also be aware that e.g. interruptions or a loss of content may occur. We recommend taking the associated risks into consideration before using RAIA CHATGPT and sharing content.

3. Limitations of Liability

Although we attempt to ensure and constantly improve the accuracy of the information provided, we and our directors and employees assume no liability and no guarantee or warranty for the accuracy, completeness as well as reliability of the answers and results generated.  To the extent permitted by law, a liability is excluded.

In any case,

• towards consumers a liability for (direct or indirect) damages or losses that may arise from the use of RAIA CHATGPT or reliance on the information provided - except for personal injury (damage to body, life or health) - is limited to (i) intent and (ii) gross negligence, and

• towards businesses a liability for (direct or indirect) damages or losses that may arise from the use of RAIA CHATGPT or reliance on the information provided - except for personal injury (damage to body, life or health) - is limited to (i) intent and (ii) blatant gross negligence. We explicitly do not assume any liability for lost profit or wasted expenditure.

4. Terms for Use / Prohibited Use

We advise you not to share personal identifiable data or other sensitive information (e.g. confidential documents), if you are not requested to do so. It is prohibited to use AI for illegal or unethical purposes. In particular, the use of AI must not lead to discrimination, harassment or violation of the rights of third parties. Users are therefore responsible for ensuring that their use of RAIA CHATGPT does not violate applicable laws. Furthermore, it is prohibited to manipulate or disrupt the protective mechanisms and programmed integrity parameters of the AI system.  We reserve the right to terminate access to RAIA CHATGPT for any user who violates these terms.

5. No Advice

RAIA CHATGPT does not provide financial, legal, tax or investment advice. Any information provided should not be considered a recommendation or endorsement.

6. Availability

We reserve the right to modify, suspend, or discontinue the service at any time without prior notice.

7. Right of Use

You hereby grant a comprehensive, royalty-free, non-transferable right of use, unlimited in terms of subject matter, time and territory, to all content entered by you in RAIA CHATGPT. The rights transferred and granted include in particular, but are not limited to, the right to use the content entered by you for the training and further development of RAIA CHATGPT, the right to transmit for all possible distribution channels, the right to make it publicly accessible by means of analog, digital or other storage and data transmission technology, the right to reproduce and to edit, the right to translate and types of use not yet known.

8. Applicable Law

For all contractual and non-contractual claims as well as for questions concerning the conclusion of a contractual relationship, the Law of Republic of Albania shall apply. This choice of law shall not result in the consumer being excluded from the protection granted to him by those provisions may not be deviated from by agreement under the law of a Member State of the European Union in which he has his habitual residence (principle of favorability). The place of performance and exclusive place of jurisdiction is the competent jurisdiction is GJYKATA E SHKALLËS SË PARË E JURIDIKSIONIT TË PERGJITHSHËM, TIRANË, Albania.

9. Severability Clause

If any of the above-mentioned provisions becomes invalid or unenforceable, such invalidity or non-enforceability shall not affect the validity of the remaining provisions. In place of the invalid or non- enforceable provision, the valid and enforceable provision shall be deemed to be agreed upon, which is economically closest to the invalid or unenforceable provision.
